TERMS AND CONDITIONS
This Agreement is between Into Aged Care Pty Ltd ACN 114 249 142 (Into Aged Care) and myself, the Client named in the Client Details
1. Initial Consultation (Level 1 and Level 2):
1.1. Appointment of a care consultant who will be my contact person and who will co – ordinate the residential aged care placement service and provide assistance according to my needs. A full assessment of my needs will be undertaken, in which I will participate.
1.2. During the course of this Agreement a number of documents will require completion in order for the service to continue. I agree that I will complete these promptly and understand that I can seek assistance from Into Aged Care in completing these documents.
1.3. Item 2 will apply, according to my choice of level of service.
2. Service:
Level 1 Placement Assistance:
2.1 I will provide Into Aged Care with a current Aged Care Client Record which indicates my eligibility to access government subsidised residential care services and will be used by Into Aged Care to search for appropriate vacancies.
2.2 A short list of suitable aged care services with vacancies current at the date of issue will be developed based on the information provided by me at the initial consultation and sent to me.
2.3 Into Aged care will make all attempts to hold the vacancies for as long as possible on my behalf however I understand that I am obligated to visit and view aged care services on the shortlist as a matter of urgency as the aged care services are not bound to hold their vacancies for me.
2.4 Into Aged Care will forward a copy of my Aged Care Client Record document to the aged care services listed in the short list on my behalf which will determine eligibility to that service.
2.5 I understand Into Aged Care will not accept an offered place on my behalf and that it is up to me to contact the aged care service directly to secure the offered vacancy.
2.6 Service Duration: Into Aged Care will commence services when in receipt of a signed copy of this Agreement together with payment of 2/3 of the service fee (incl. GST). The service will be taken to have been completed when a minimum of three vacancies are found and offered to me that meet the requirements specified by me at the initial consultation. At this point I will be invoiced with the remainder of the service fee. Any requests for service after this will be charged at an hourly rate of $88 per hour (includes GST).
Level 2 Placement Assistance:
2.7 I will provide Into Aged Care a current Aged Care Client Record for the person to be placed which indicates their eligibility to access government subsidised residential aged care services and will be used by Into Aged Care to search for appropriate vacancies.
2.8 I will also provide all documentation requested by Into Aged Care that will form the application to any government subsidised residential aged care service.
2.9 A short list of suitable aged care services will be developed based on the information provided by me at the initial consultation and sent to me. This list may be reviewed and altered depending on the changing needs of the person to be placed.
2.10 Into Aged care will make all attempts to hold the vacancies for as long as possible on my behalf however I understand that I am obligated to visit and view aged care services on the shortlist as a matter of urgency as the aged care services are not bound to hold their vacancies.
2.11 Into Aged Care will not issue applications to aged care services not sighted by the Client/Authorised Representative. This obligation may be waived by Into Aged Care under certain circumstances if agreed in writing.
2.12 If required, Into Aged Care will attend a maximum of 6 home/property tours within a 30km radius of Melbourne CBD. Tours in access of 6 or outside of the area will be charged at a rate of $88 per hour or part thereof.
2.13 Into Aged Care will forward applications to the residential aged care services which I have toured and approved and I have notified Into Aged Care that they meet my requirements. It is the responsibility of Into Aged Care to liaise with the aged care services regularly to advocate my priority on the waiting list.
2.14 It is the responsibility of Into Aged Care to liaise with relevant hospital staff involved in the care of the person to be placed if they are in hospital or transitional care regarding the progress of placement.
2.15 I authorise Into Aged Care to accept offered places on my behalf from those services which have received applications and have been indicated by me to meet my requirements.
2.16 After a permanent place has been secured Into Aged Care will notify other wait listed services and remove the name of the person to be placed from the waiting list.
2.17 Service Duration: Into Aged Care will commence services when in receipt of a signed copy of this Agreement together with payment of 2/3 of the service fee (incl. GST). The service will be taken to have been completed on the earlier of:
2.17.1 when sale contracts are accepted or permanent placement is secured;
2.17.2 a minimum of three vacancies are found and offered to me that meet the requirements specified by me at the initial consultation; or
2.17.3 six months from the commencement date, unless extended by written agreement.
2.18 At this point I will be invoiced with the remainder of the service fee. Any further requests for service after this will charged at an hourly rate of $77per hour (incl. GST).
4. Service Fee:
4.1 Payment of two thirds of the quoted fee (including GST) is required at the time of signing this Agreement as a non-refundable deposit. This is to cover all time spent in set up and administration. The remainder of the service fee is required to be paid within 14 days of being invoiced.
4.2 If the service cannot be completed for any reason Into Aged Care will charge a reasonable sum for work performed but not covered by the deposit.
4.3 Service completion Level 1 – I acknowledge that if the service is taken to have been completed under item 2.6 the full fee for Level 1 service will be due and payable, even if a permanent placement is secured at a residential aged care service that was not referred by Into Aged Care.
4.4 Service completion Level 2 – I acknowledge that if the service is taken to have been completed under item 2.17 the full fee for Level 2 service will be due and payable, even if a permanent placement is secured at a residential aged care service that was not referred by Into Aged Care.
4.5 Into Aged Care reserves the right to withdraw service when the deposit remains unpaid.
4.6 Into Aged Care is not liable for any residential agreements or contracts entered into for purchase, rental or placement acceptance of residential aged care services by the Client/Person to be placed and vendor/service provider.
5. Grievance:
5.1 If I am unhappy with anything in relation to the services provided by Into Aged Care, I have the right to discuss these concerns with my consultant, or contact the Managing Director of Into Aged Care to resolve the problems which I am experiencing. This will not affect my eligibility for service.
6. Termination:
6.1 Into Aged Care may terminate this Agreement immediately by notice in writing if:
6.1.1 any payment due from me to Into Aged in relation to this Agreement remains unpaid for a period of 14 days or;
6.1.2 I breach any clause of this Agreement and such breach is not remedied within seven days of written notice by Into Aged Care;
6.1.3 my situation is such that I no longer require residential aged care accommodation;
6.2 Notwithstanding the preceding paragraphs, Into Aged Care may in any event terminate this Agreement by giving 30 days’ notice to me.
6.3 If termination notice is given to me in relation to the above, Into Aged Care may, in addition to terminating this Agreement:
6.3.1 retain any moneys paid;
6.3.2 charge a reasonable sum for work performed in respect of work which has not been previously charged;
6.3.3 be regarded as discharged from any further obligations under this Agreement; and
6.3.4 pursue any additional or alternative remedies provided by law.
